    Need Advice Quickly - CAN SOMEONE PLEASE RESPOND

    Hi all,
    I know that someone can help me out here...long story short"

    Filed Chapter 13 in September 2001 (included all secured debt - 1998 Ford Explorer). Payment plan was 600 month to be paid directly to secured creditors for the first four years, etc. At any rate, in September 2005 we decided to convert our chapter 13 to a chapter 7 so our attorney moved to have our chapter 13 dismissed and we filed chapter 7. The trustee did dismiss our chapter 13 and sent us his final report of payment. Mostly everything had been paid off during our 4 years in the bankruptcy and the balance that was owed on the Ford Explorer was shown as ZERO on the trustees final audit report.

    Fast forward to today...we had not received our title to the Ford Explorer and we were wondering what was taking so long. Well, lo and behold, when we did get in touch with Capital One Auto Finance, they asked me when did I want to make arrangements to pick up the Explorer!!! Needless to say, I was in shock. To my knowledge, and according to the trustees records, this was paid in full!!!

    Can someone please offer some advice as to what we should do. I have a call in to my attorney's office but they have left for today. I just need some sort of advice to help me through the night!!

    There's probably no clear answer, unless someone else has had a similar experience.

    I'd imagine chatting with your attny ASAP tomorrow is the best start.

    Maybe call Cap One and see about getting a fax number for the appropriate department from them. Maybe you can fax them a copy of the Trustee's audit showing the acct paid in full.

    At least that's something pro active you can try on your own while you're waiting to talk to your attny.
