how do the bk court figure out what your payments will be after filing and is up the judge what he decides or by money left over from pays.

You and your attorney propose a plan, pretty much based upon allowable expenses from the means test and actuals that are allowed. Based upon all that information, you arrive at a disposable income figure. That is your monthly payments. Most have said the amount is usually accepted, while others have went in and some changes were made. I believe if you and the trustee can agree on a figure, it pretty much is a rubber stamp by the judge unless something comes up.
