    creditor question

    It seems to me that whenever a creditor calls and you tell them you are in the process of filing for bankruptcy that they then put you on hold. What's the reason for that? Are they tape recording the phone call or just pulling something up on the computer? Just curious.

    I haven't had that experience. Generally they ask if we've already retained counsel. Yes. Then they want the name and phone number of the attny.

    Odd that you'd be put on hold. Maybe new people calling and they don't have experience with what you can and cannot say to a BK filer??!!

      Yes, they are probably pulling out a manual that gives them direction on what to say next to a bk client!! Or more importantly, what NOT to say!

        As one of those creditors, I can say from the place I work at it's because we are quickly reviewing the notes on the account to make sure either a) we have the info for the lawyer, etc yet or b) make sure you're not a 'jumper.' Those are folks who every so often say they have filed, give some info or not hardly any, just to get out of paying for a few months when in fact they haven't even seen the inside of a lawyers office to consult on filing. Where I work at, if someone says they have filed, you get the lawyers name, office #, chapter that is filed or will be filed, etc. After that we don't contact. (Some places will continue to contact until the case is filed, though.) Where I work, the only time after that the person is contacted is if a) the attorney refuses to answer the demand letter or b) the debt is reaffirmed. *Footnote- if the atty refuses to answer the demand letter and we contact the customer, it's not to collect, it's to tell them, 'hey, your lawyer that you are paying big bucks to is not doing his/her job.'*

          It's great to have people here who work on the inside to tell us these things.

          Just curious, Lost,.............. But, What's a Demand Letter??

          I fig'd when I gave the CC's my attny's name and phone number, someone was contacting his office to see if we really were clients or not. Just a guess that the CC would follow up on that.

          And I have heard it both ways from our Creditors. Some say they update their info so they won't call us again. Others say they'll continue to call until we actually do file.

            To break it down quickly, the best way to describe a demand letter is something that's sent to the lawyer that says "hey, we were given your info as the person representing Joe Smith, etc., is this the case, etc." It depends on if it's a BK case, what type, or a estate case as to what kind of letter gets sent.
            I'm not a lawyer or legal expert, just offering advice on what I may have gone through and/or have knowledge of. Good luck!

                So I was kinda sorta right. They are following up to see if we told them the truth. But all they ever ask for is name and phone number, so I fig'd the CC's called the attny's office. Makes sense that they probably already have his address on file. Probably enter the name and phone number and just pull up all his info. Hit enter and spit out a form letter.

                  I had to reply - you would be stunned as to how on the money that is. Of course, I'm waiting for the day when the person who owes the money is a lawyer. (I HATE calling lawyers.)
