We have filed for emergency custody of our nephew as both his parents are serving prison sentences. The legal fees and extra costs are wiping us out. Can a payment for 1 month be deferred so we can get some breathing room? Thanks.

You need to contact your attny, that filed the Ch 13 for you, and inform the attny what's going on.
If you filed Pro Se, you need to contact the Trustee directly.
The Trustee may allow for your plan to be ammended. Other people have had payments significantly reduced for 2-3 months to allow for medical expenses and such.
No harm in asking. All they can do is say No.Filed Ch 7 - 09/06

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

Yes, you actually can. As SF indicated, you must contact your attorney if you used one, and if not, the trustee. Go to your BK courts website to obtain the forms used in that court.
One thing I did read, if you are "allowed" to skip payments, the arrears must be made up prior to the end of the plan. In other words, you might miss a couple of payments, but you'll still end up paying the same amount into the "pot".Chapter 13 Filed 4/03/06  341 Meeting Complete 5/11/06 :yes2:
