    Consult with Attorney Next Week

I bit the bullet and have a free consult with an attorney next week. He is also a trustee and is a block away from where I work.

He was really nice on the phone and basically started with "why are you thinking of bankruptcy?" and do you know about the two kinds. I told him I think I qualify for Ch 7 because:

    * I'm under the median income for Colorado
    * My equity falls below the homestead exemption
    * Most of debt is unsecured (medical & credit card)
    * My secured debt (home and HELOC) are up-to-date and have never been late.

    He goes, "Any student loans?"

    * Yes, but I know that even though they're unsecured, they won't be discharged.

Had a little chat about home values and he was really happy I had a nearly identical townhouse sold Saturday (says that's about as good proof if not better than appraisal.)

He goes, "You've certainly been doing your homework!!"

    * I said, "Yes, I read a lot." (Figured I should just stop there and let his ego live.)

    Wish me luck!

Report back to us and let us know if the two attorneys say the same thing....

Yeah, better to save his ego...................

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

No harm in letting them know you've done some "research", but don't let on that you know as much as you do.

Most we met with didn't mind answering our questions. It was like they were glad to see someone who had a clue about what was going on. But don't go too far.

DO NOT mention PACER to them. That's like, taboo, for clients to have access to that in attny's minds.
          Filed Ch 7 - 09/06
          Discharged - 12/2006
Officially Declared No Asset - 03/2007
          Closed - 04/2007

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

I won't mention PACER, but let him know I read BK for Dummies (LOL) and one of the NOLO books.
