Husband filing BK and I am not...

My husband and I just got married in Dec '04. He has an enormous amount of debt that he is getting ready to file bankruptcy on. We have not contacted a lawer yet because we are waiting to get our taxes done first. (We need the tax refund to affford it). My question is this: How safe are all of my assets???

You see, the husband aquired all of this debt before we even met. I had no part, what so ever, in piling up the debt. I have excellent credit. I am 21 years-old and have a really nice car that *I* am paying for. I'm very afraid that my car may get taken. If only he files, my stuff should be safe right?

Another question, we are filing our taxes together, and as long as we do this and get our check before we file for BK, no one can take our money right?

Who's name is on the registration/title for your nice car? That's the real issue - who's name is on the debt? secured or unsecured - home, autos, boats, etc. Don't use a credit card with his name on it for yourself. First visit with an attorney is usually free for fact finding for both parties - use a few of them. Check the yellow pages under attorney; the BK attorneys list as such call and make appointments.
