    New worries, err questions......

    Ok, this divorce is now making me sick! Next court date is late Aug. I fear that it just might go into the next year. What is funny, is that I'm fighting for "marital debt" on the credit card. But, I'm considering bankruptcy. LMAO.... Why am I fighting for this? Origionally, I felt for MBNA, and I wanted to pay them something, and I wanted the ex to own up to usage on this card. But does that really matter? MBNA have been aweful to me on the phone lately. They have called me at work. The next time they call, I will tell them "that person no longer works here." I have looked up the phone number from my caller ID, on switchboard.com, I now have an address for MBNA Marketing Systems in Cleve, Oh. Maybe I need to send my "stop bugging me letter" to that address.

    I am considering seeing a bk attorney to see what my options are as to going ahead with this or wait till the divorce is done.

    I have been trying to gather info, things I know I will already need:

    1) When I left my ex, my boss put me in a condo on the business site. I never did sign a lease agreement.

    2) When I got married, I called my insurance co. and repeatedly told them I had a new name. My insurance co. never changed my name. and I gave up because at some point I knew the marriage was not going to work anyways. When I moved and added renters ins. to my policy, He asked if I wanted to change my name now. I told him I hadn't decided if I wanted to take my son's name back, or my maiden name. So, I told him to leave it alone. I didnt see a purpose to change it then, then change it again in 6 months or so? Again, I was not even considering bankruptcy at that time.

    3) Should I wait till after bk to change my last name? I will not be keeping this married name, but I can put it off it is better for bk puposes?

    4) Apon leaving my ex, he proceeded on threatening me if I touched HIS money, that my child would be motherless. Then, he cleaned out the joint account. I went to the credit union, as I am the primary on the account, I tried to close the checking account, but because my car loan is through them, I was not permitted to close it. I did take his name off though. It has been left with $1.50, and I have not used it since. I actually have a fear at using this account, because all the money had been taken from me. And I'm not sure if he has the routing and account # still. It is just something I will never get over I guess. However, I am trying to get statements from this account too, I am signed up with EStatements, and they are supposed to provide a years worth online. But when the account became "dorment" They only have statements for Jan, March, and May 06????? Do banks cut back on providing monthly statements when your account is unused? What is the trustee going to want to see of this account, especially if I should wait till this divorce is finalized, and when I get the funds for bk, it might be next spring?????

    5) Ok one last thing, is anyone here from NE OHIO??... what are the attorneys for Ohio asking for?

    Ok I think thats enough worrying for one night. I can't take much more of this.

    Well, I don't know if I'm right here or not, but,............ If it were me going to mess with my name,........... Personally, I'd ruin his name, and then change yours after BK. Even tho you'll have to declare the BK on "official" documents when you apply for Credit and such, no one else will connect Jane Doe who filed BK with Jane Smith, your maiden name.

    Your attny will want to have 2-3 months of bank statements on file for the Court should they ask to see them. Unless you're filing right away, you shouldn't have a problem getting those for your attny by the time you file. Especially on a basically dormant acct.

    You're gonna need to get some sort of Lease Agreement drawn up and signed for BK purposes. You'll need it to establish expenses.

    About your insurance,........ You probably wanna ask the attny about that. I'd imagine it will be easier for you and look better to the Court if the name is the same as when you file BK. Just a guess there. Your attny will know better.

    There are several people here from Ohio. I'm sure someone will chime in for you with local info.
