ANother question on chapter 13 to chapter 7?

Hubby and I filed chap. 7 in October of 1999. We are currently looking at the option of filing chap. 13. We have been told by lawyers in our state of Arkansas that you have to be discharged 8 yrs to file chap. 7 again. Which would be our first choice. My question is if we file chap 13 and next October or later when our 8 yrs are up can we convert it to a chap 7? Thank you for your help

Yep! You should be able to convert from 13 to 7 once the time limit has expired on your previous Ch 7.
    Filed Ch 7 - 09/06
    Discharged - 12/2006
Officially Declared No Asset - 03/2007
    Closed - 04/2007

Sorry to hear you're looking at this situation again. What happened?

We were doing great and then decided to take on a Car payment that was pretty high. Then with in the last yr since purchasing the auto hubby was off work with illnesses, I was laid off and now things are just more than we can handle.
        Thanks for your replies.
