Can illegal immigrants file for BK?

Illegal immigration is a really hot issue around here. I know that you don't have to be a US citizen to file for BK, but could illegal immigrants file?

Ummm, why would they need to? No social security number, so no credit report!

But so many of them have doctored up papers, I'm wondering if it would fly. But heck, it's easy enough for them to fly under the radar anyway.

why would they risk drawing attn to themselves? If they were able to get doctored papers don't you think it would be easier to get new papers/new identity instead of exposing themselves to the govt?

Yes they can file for bankruptcy you only have to be an adult person within the monetary limits and living in the juridiction for the prescribed time to file for personal bankruptcy. In fact not only do illegal aliens do it but terrorists too. Thats because its all about money not principle never mind that the credit card companies are making money so easy to borrow that they are a major funding of terrorism just nukle down on the middle class to flip the bill with high interest rates.

Most Government agencies don't "rat out" illegal aliens. I once worked for a company that hired day laborers -- all illegal. They complained to the Department of Labor that they weren't getting over time. The Dept. of Labor investigated the company I worked for and back charged them $100k in lost OT which had to be paid directly to the illegal aliens. When asked how they could get away with that, the Dept of Labor representative said "it's our agencie's mission to insure that workers get paid fair wages, not to insure they are in this country legally, we do NOT report illegal aliens to the INS"

She also told the owner of the company that if he didn't "anti up", she would dig further into his business and basically make his life miserable. But if he paid the $100k to the illegals, she'd close the case.

Since this was a concrete contractor in New York (LOL), he didn't need any further digging and paid the $100k.

Normally I would say that this is unfair, but the company really shouldn't be hiring them. The Dept. of labor of course works harder for them then they would us, but if businesses and individuals would stop hiring them, they would go away and stay away. You know....it irks me when I see these marches demanding rights....then again it's not their husbands, boyfriends, or children fighting these wars to protect those rights or their loved one coming back in a box is it? That pisses me off big time! I get to watch my boyfriend take off to Iraq and put directly in harms way so they have a cushy life....and yes I did say cushy because truth be told NO ONE in the U.S. is really poor. We feel like we are (myself included), but seriously if we look around us....we aren't that bad off.

The other thing is, I had a friend go apply for a housing program so she could finish school......they were letting illegal immigrants take the housing for $25 a month and she has to sit on a waiting list for 18-24 months waiting for one of them to get off of it???!!!!! What kind of crap is that!!!!!!!!

I was reading an article that a once illegal immigrant joined the service fought for our rights and when came home due to a discrepancy in papers he was deported, now I am on both sides when it comes to immigrants BUT in his case I was shocked that it could happen.

That really sucks! Millions are taking jobs and making tax free income while using services and no politician in any political party has the courage to fix this. One brave man did the right thing by earning his right to stay and fight for our country and he goes. Really F..d up!

Yes, I agree -- small businesses should not be hiring them, it's adding to the problem.

But those links you posted, well, they just hurt my heart. There was a time when I would have said "I don't have a problem with immigration, just do it legally". However, after what I've been through in the last two years, I truly know "desperation" to just survive. So, I can no longer stand on my soap box.

Yeah, it pisses me off, but in the end, we are all human beings trying to survive on this earth and take care of our families.

My financial issues haven't changed me a bit on this issue. I will always abide by the laws of our country whether I agree with them or not and you did to Wenderful especially with your bk case. I always had and always will continue to have the stand that immigrants are ALWAYS WELCOME LEGALLY. They should wait on line and do the right thing by registering, becoming legal, paying taxes to the social safety net that they use so much and bring the badly needed talent to the USA as immigrants have always done. The officers at BOA and others should be thrown in jail for harboring illegals.

Agreed this would really suck....because this person in my opinion paid their dues. However, this is an exception to the general rule. You don't see this rampantly happening. I think that persons mindset was probably a little different, because they were probably thinking I owe this country something....not what can I get for free. I just don't like this new wave of thinking that this country owes them something. What's owed to them are wages if they worked and that's it. We don't owe them food, housing, healthcare, heat, energy, transportation, education.....etc, etc.....

Also most insurance companies will not insure them because they do not have driver's licenses (to me this is a priviledge and it goes along with residing in this country legally). So what happens when (real life situation) one of them gets in an accident with you and tells the cop they have no insurance, gets the ticket to the accident, and turns right around and files a claim against your insurance? That actually happened to me....oh and by the way he did have insurance it was just some cheesy one.

What about all the crime that happens as a result of them?

The above is a nice little story about an illegal who came out here....acted a fool and killed a cop out here. This seems to be more what ends up happening. Seriously, how many illegals do you see out there acting civilized as opposed to acting like fools?

Personally I'm embarassed. I'm actually first generation American. My parents are Mexican and I don't agree with it.

Don't get me started about immigrants in the services. Yes, I 100% agree that they should be allowed to become citizens after a period of time, especially those who serve during times of war. However, Bush should have been ashamed of himself for using that injured immigrant in one of last speeches to show how this guy had been serving in the military for 25+ years but just recently gotten his citizenship and good ole' Bush was there to swear him in. Well, there have been laws in place since the 70s so this guy for whatever reasons was not taking advantage of something that was available to him. I don't know if he just didn't know about it, or didn't desire citizenship due to now since he knew he could still be deported. The US services has a special division just to help immigrants process their papers to become US citizens--they're bending over backwards to help people that fight for our rights to become US citizens, they're actively pursuing people they may think are illegals just so that they can get their due citizenship. But you can only lead a horse to water, you can't make them drink.
