    New to all of this....

    We have pretty much decided to file Ch.13. We are seriously past due on our mortgage and have been trying to work with them on a payment plan, but every attempt I make to contact them hasn't worked. I have all the paperwork in and I got a letter telling me they would contact me in 2 weeks and that was back in June. Every time I call and talk to someone they say that they are still working on it and my processor will call me back. Well today I called and left a message for her supervisor. We'll see if I get a call back. We also got our foreclosure notice yesterday. It states we have 20 days to pay what we owe and I don't have that money.
    So its onto ch. 13. I have been reading this board for a while since we started looking into the process and it is very informative.

    My biggest question is once we file does this automatically stop the foreclosure proceedings? I am waiting for my lawyer to call me back so we can sit down and start the process. Right now our biggest concern is not losing our house. And since our mortgage company has been no help at all this is our best option. We do have a lot of debt also. We have about $7000 in medical bills, about $5000 in cc, I have a repossession that right now wants $10000. We also have a heloc but that is caught up at the moment.

    You are at about the point we were in the foreclosure starting process when we filed, and it does immediately stop the proceedings once you file. Your attorney should be able to advise you on the rest, but dont waste any time!
