My fiance cosigned on a car that I included in bankruptcy (chapter 7). I have been making enough payments to keep the finance co at bay as far as taking the car back but never signed a reaffirmation agreement. Ford told me that all payments were voluntary. Ford is currently putting negatives on my fiance's credit with 30 day late payments. However, they have never sent him statements or tried to collect from him. If the debt was satisfied by the chapter 7, then how can they keep putting negative marks on his credit, shouldn't they have to make an effort before they start giving him 30 day late marks?

This bankruptcy took place in Texas.

If the payments are current each month, they should be reporting this. However, all co-signers will be affected under bankruptcy. This account would stated that a Chp 7 BK was filed. If you filed through an attorney this would have been communicated to you!
