    BK Petition Schedule G

    I was in our attny's office today dropping off some updated paperwork. I happened to ask the paralegal if our current Landlord would have to be notified of our filing BK. Our Landlord is, after all, a Creditor. One we fully intend on paying.

    The paralegal said our Landlord will be listed on Schedule G. And, NO there was no reason the Landlord would be contacted.

    The reason I wanted to know is to give our Landlord a head's up BEFORE that letter ever arrived, IF they were gonna get one. Explain what's going on and that we are not including them.

    When I got home, I looked up Schedule G. It has to do with Unexpired Leases and Contracts.

    So, OK, Fine. That will work for our Landlords. But what about other things we have going and fully intend to pay.

    Such as an Orthodontist. When our daughter was being seen, we signed a contract, paid so much down, and so much/month for 24 months. Could an attny include an orthodontist agreement on Schedule G??

    Hi SF. Are you "borrowing" anything from the orthodontist? I think something like that would just be an unsecured creditor. Unless you actually have a device at your home, I would think it would be treated like any other debt. They would be discharged in your BK but you could pay them outside of the BK and keep them on your good side. that is what we plan to do with a medical bill that we owe a $459.00 balance on.

      I threw out Orthodontist 'cause it's something we dealt with.

      The Dentist assesses what needs to be done. Outlines the plan they wanna follow. You agree. Sign a contract agreeing to pay. In our case, so much down and so much/month. The Dentist puts braces in your kid's mouth. For the next 2-3 years, or so, you go in monthly or every other month, for a check-up and possibly adjustments. It's an ongoing treatment plan.

      A Rental Lease is a Contract. What about other things like this where you agree to pay over time??

      There are people who like their Dentist, Doctor, mechanic, whatever, that wanna keep their services. Can those types of bills fall on Schedule G if you've signed a Contract?
