    Self-Employed and Ch 13

    I'm retired military and have a regular retirement income ~ 32k. The rest of my income is derived from self employment (my wife and I) and it varies from month to month. Some month chickens, some month feathers but on the average a couple thousand a month. My wife does not work as we have a disabled child that requires full time care when he is not in school.

    I read somewhere that you have to have a regular income for a Chapter 13. What if we made too much money last years to qualify for a seven, but don't have a regular income required for a 13? Any insight will be appreciated.

    Do not own a home
    One leased car, one car 6 years old with 90K. No equity in the vehicle.
    60K in unsecured debt.
    Age 57 - (Finally realized I was never going to pay off the debt in my lifetime)

    Well, I am going through an attorney at this moment to file chap 13, and I am self employed...she hasn't said anything about NOT being able to file either one 7/13 because I am self employed...we are still in the opening stages, but she did ask me for a "profit/loss statment" ...that is for self employed people...your accountant (if you have one) can probably give you that or show you how to set one up. My husband is good with those things so he is going to do this for me....sorry I can't be more help than that, but I still think it is ok for a chap 13 on self-employed....anyone else???????!!!!
