Question Re: Excluding a card in your filing . . .

Another quick question re Chapter 7 list of creditors:

Is it legal for us to exclude a credit card from our list of creditors? We have a card with a relatively low balance that we'd like to keep.

Can we simply not include them in the list of debts, or do we have to include them, reaffirm, and then hope they allow us to keep the account open for emergencies?

    Thanks for your advice!

Technically, you are supposed to list all your creditors. However, people can be forgetful :p

Also note, not all companies close your account after a BK, if the balance owed is relatively low at time of discharge, odds are, the bank will keep the account active after the discharge.

In either event, do not use a credit card while your BK case is pending.
