    I have a few more questions about walking away after BK.

    Bankruptcy finished in June, did not reaffirm 1st or 2nd.


    If I surrender my home to the lender and I move into a rent-to-own home and make payments for 36 months would that be enough time from foreclosure to get a loan for the rent-to-own?

    I have found a few houses that I am interested that will take the down payment and a certain percent of the payments and put it as part of the down payment when we take over the mortgage 36 months later.

    If I was to surrender the bank can not make me pay the difference, correct?

    Thanks for any advice, not trying to be a pain but I did not realize I was stuck with this house if I did not walk away at time of BK.

    36 months from when your name is removed from title for an FHA loan. The problem is it could take a year or two for the bank to actually foreclose, thus making your actual wait time longer than three years

      And...since you filed BK...they cannot make you pay any deficiency....
