    Bank account question

    I retained my lawyer for Chapter 13, will file in about a month. My lawyer said not to close my checking account and just to get a new one. I did that. On my old checking account the credit union closed it today because it went into the negative. I have alot of payday loans and their fees came out today along with a couple that were actually the whole amount due. I did not close it but the CU did. I was advised by the attorney to stop paying these and other loans that I have and when they call me to tell them I retained an attorney for BK. I had a couple of store front payday loans due today that I am sure they will send in next week.

    My question is, what will happen if the account is closed. I had a savings account with the CU as well and they moved the negative fee to that account. I am worried that I could get in to criminal trouble, because they are going to send those checks in and that account is closed.

    I live in Missouri, any help is appreciated. Thanks.

    Each state is different; however, at the time you wrote the checks, which were postdated, the account was open, so you have no criminal intent. Also, for Colorado as an example, postdated checks do not fall under Criminal NSF cases.

    What you're dealing with is a civil situation- not criminal.
