    How long do we have to file?

    We found a lawyer at the end of June. At that time she suggested we stop paying credit cards.

    We have a small business (that we are trying to keep going), so it's taking us a while to gather our paperwork, etc. Also, it took several weeks to pay the lawyer.

    We've only just recently notified one of our creditors of our intentions to file (we've avoided the rest so far, per oiur lawyer's recommendation). How long is too long to take to officially file?

    Any help is greatly appreciated.

    Hve you done your credit counseling yet? If so, you have 180 days from that date. Otherwise, as long as your attorney is retained, I think it does not matter how long you take.

      We retained and stopped paying all cc in March. The phone was ringing off the hook from 8am until 9pm every hour, every single day until we finally answered and told them all that we were filing. They asked for the atty name, phone number and claim number. We didn't have the claim number because we only retained him and have not filed yet. Each and everyone of them was pleasant and very understanding. None have called since. I'm surprised your atty told you not to tell them your filing-ours told us at our initial meeting to give them all his info whenever they called.
      Anyways, you should have plenty of time and use this time to save up the money that you were paying your cc with for an emergency.
