    Ch 13 and Mortgage payments by the trustee

    This may not be the correct forum but perhaps someone can enlighten me.

    I filed a chapter 13 plan in april of this year and long story short we should be getting a confirmation order this month or early in December. At that point the trustee can release funds they have been collecting to secured creditors, namely my mortgage company. If the the trustee does not get the payments to my mortgage company by the end of the year but they are for past payments held in trust by the trustee after the plan was filed will I still get the tax deduction for the accrued mortgage interest on my 2010 taxes?

    No, but you would get to deduct it the following year. You can only deduct the interest in the year that it was paid (received by the mortgage company).
    Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
    0% payback to unsecured creditors, 56 payments down, 4 to go....
