    Foreclosure on a rental.

    Is this how it goes?:
    File BK.
    Automatic stay.
    The rental would be nonexempt, so motion to lift stay.
    Lender places notice of default.
    Property is sold after appropriate notice given.
    Then, whoever is occupying the property needs to vacate or will be evicted?

    Are you the renter or the landlord in this situation? I wasn't sure when I read your post.

    I owned a mobile home I rented out when I filed BK but it was empty by the time I filed. I just stopped paying on it and the process took care of the rest. But if I'd still had renters in it I would have told them I was filing and what was going to happen so they could look for another place to live. Once I'd gone that far I wouldn't have cared if they paid the rent or not because I wouldn't have wanted the income. I would have given them the expected timeline so they'd know how long they have to find other houseing and given them their deposit back in the form of a rent-free month or two. I didn't have to do any of that though, because my renters moved out when their lease was up, which was right before I filed.
