    Notice to Absent Defendant - ?

    I'm back. Here's a recap of my situation. I'm in NJ.

    Purchased house: Feb. '08
    Bought with my ex - we are not married - tenants in common on property.
    Broke up in end of 2009
    Fell behind then stopped paying mortgage April 2010
    Filed Ch. 7 bankruptcy Jan. 2011
    Discharged July 2011
    Married (someone else just to clarify) in July 2011 (after discharged)
    Starting house hunting with husband Feb. 2013
    Contacted mortgage and Co-Owner (my ex) to do Deed in Lieu of Foreclosure
    Husband bought a house April 24th, 2013
    I faxed my portion of the DIL on June 11,2013
    Co-owner has yet to file his part.
    Received a Notice to Absent Defendant yesterday - however it has several dates on it
    a) The letter from the lawyer representing the Mortgage Co. is dated June 24, 2013
    b) The summons from the Superior Court says i must Answer within 35 days after June 27, 2013
    c) The legal document that I'm assuming is the actual suit that was filed says it was Filed and received on May 02, 2013

    Here are several questions that I'm hoping someone can shed some light on....I'm planning to try and contact a lawyer as well but this forum helped me a lot during my BK so here I am again

    1) Do I absolutely need a lawyer at this point?
    2) If the co-owner submits his part of the DIL application soon, will that halt foreclosure proceedings? or is it too late?
    3) Can a judgement be filed against my husband? Can they go after him? Will it affect him in any way at all?

    Any other information anyone can give me or advise or experience would be of great help. Thanks!!
