    Can owed sales taxes from a S corp be dismissed

    We are going to be filing ch 7 (I think) but owe about $25K in sales taxes from our business? Any chance to have it discharged?

    Unlikely to get sales tax disch in Ch 7.

    Are you filing personally or is the Corp filing Ch 7...? Not that it matters all that much really, but often folks file personal only and corp lives on, just owing lots of uncollectable debts w/o consequence. But the taxing authority will still look to you personally for those taxes owed.

      Odds are the sales taxes cannot be discharged in BK.

      Most states (probably all) have a statutory mechanism to hold the owners of a corp liable for unpaid sales tax.

        $25K owed in sales tax? You're either way behind or sold a bunch of goods.

        Better be finding a way to come up with the 25K. The sales tax people can be rougher than the IRS.

          If you file close the business, file bankruptcy and then start a new business with a similar name, I would think that might work.
