    Credit Union /Credit Bureau question

    I have a question regarding my CH 13. (OLD LAW )
    Background
    I submitted all my accounts and debts to my atty for filing in Oct,2005

    Atty neglected to file 2 major credit cards that was amended and they were included early on.

    One Credit Union Loan of 9K was NOT listed. (I was paying on this for some time). Believe it or not I just realized this. The atty was informed of this loan initially. He was told by me that I contacted them directly (once in October 2005 and again in December 2005).

    I directly wrote to the CU to inform them of my intention to file Ch13 and to cease auto-withdrawl of 263 per month. This took 2 return receipt letters direct to the CU to accomplish. In each letter I included the atty's business card. In each letter I asked them to contact him to submit a claim. Also included: all pertinent info
    my address ,soc sec #, loan #, all telephone contact numbers for me. They obviously received this info and stopped the auto- withdrawl.

    Question
    When I checked my credit bureau reports recently this loan was not listed.

    Is this how creditors are notified by the court? I have misplaced a copy of the letters I sent to them but DO have the 2 certified mail receipts.

    What can I expect to happen to this loan?

    P.S. I am in awe of the incompetence of some banks and credit unions and attorneys. I never had exposure to this process before.

    Why this has been removed from your Credit Report I don't know. Perhaps in error.

    Main thing was it included in your bankruptcy petition and the CU notified of the filing of the petition. You notified them your were going too..........but did the Court notify them that you had!!!

    The debt may still be floating out there in space somewhere, waiting on you......

    Did you have any other loans thru the CU when you filed? If so, all loans may have been combined on your petition...... and the CU was informed.......

    Check your petition and credit matrix................

    Was this paid off in your Chapter 13???

    Your attorney needs to "clean this up".........its his mistake......

      Thanks I need to get to work on this
      This loan was NEVER reported to the Credit Bureaus it has NEVER been listed.
      The Court never notified this CU.
      I was the one who notified them.
      I will find my petition and see if they were listed.
      I found this process confusing initially and relied on the atty's skill and judgement.

        Since you are in a Chapter 13 I see no reason why this creditor cannot be added to your matrix and notified by the Court that you have filed bankruptcy.....

        Get your attorney on this right away....... make sure its included....

          My attorney thinks I am nuts for pursuing this. And "will get back to me" in a couple of weeks ! He thinks I should see how it plays out. Whatever that means. Yikes !

            On one hand its really annoying when the atty you are paying is being dismissive but on the other hand CU knows you intend to include them and you aren't paying them and they aint bothering you so I could see why he's in no hurry.

            However "see how it plays out" sounds retarded. CU needs to be added to be discharged or they will eventually come back for the money. Whatever.
