    How long until I receive my "Discharge"

    Anyone in NYS know how long it takes from your last CH 13 payment until Trustees sends the official discharge to us ?

    I'm in NYS too and we made our final payment in mid-November 07. well at least technically speaking; the payments to our trustee JUST finished. i've never felt such a sense of relief. i'll get my first full paycheck in years very soon!!

    The trustee's office conducted an 'audit' (review) of our case during December/January and the last disbursement to our creditors was made the first week of January.

    Our case was finally closed by our trustee end of January. We got a letter from the trustee in early February that specifically said that while our case was considered complete and CLOSED by the trustee's office, the federal bankruptcy courts still considered the case open and the trustee's office would not be able to make a final report to the court to get our discharge until after all our creditors had cashed their checks. In our district, the trustee said they have to give them 90 days.

    So, my husband and I are thinking we will hopefully have our actual discharge maybe sometime around May. it's been a long hard road ... good luck!

        How did you know that your "... last disbursement to our creditors was made the first week of January." Did they send you a letter, did you telephone them, see it on line.." Each time I call (in Albany)it seems like they are burdened by having to talk with me, just ell me to wait. I can't believe a creditor wouldn't take a check and cash it in 24 hrs vs 2-3 months.

          Hey Tribeca: Sorry it took me a few days to get back to you. I noted our last disbursement as according to 13datacenter and I verified that with the trustee office as well. To be honest, at that point I was more concerned about the payments ending and when that would happen (we were auto-deduct from paychecks) -- which is why I even called in the first place. But be persistent with the office, it would take me a day or so to get a phone call back but they always did.

          I guess in an odd way, I can almost see why creditors might not cash a check all that quickly. Two of our creditors received a final disubursement of one penny. Another got 13 cents. Ridiculous but we still have to give them their alotted time.

          The trustee also told us that it may take UP to 3 months ... it could be sooner. But I think their office is so 'automated' that and on a strict timetable that we probably wouldn't see anything for a month or two anyway because of how their system works. Like, the office told us that the final payment that completes your designated plan base will automatically get you "flagged" in the system as being done ... but they didn't even start processing our audit until that month ended and they started the new month's disbursements. Ya know what I mean?
