Hi Everyone:
I am just curious if Social Security (SSI) debts can be discharged in Bk? I owe about $5k due to overpayments that I received for my child. Since he still receives a check each month Social Security takes a percentage out of each check to pay back the overpayment. Once the checks for any reason, I usually will get a notice to send a check or charge my CC for the full amount or make payment arrangements. Since this is a debt, it would be foolish not to include it in my filing, but I wonder if would jeopardize my child's checks due to a disability. Also I am paying back each month unemployment. They said that I received more $$ than I should have so I am wondering if I can discharge this debt too. These are not listed on my CR's as debts.
As far as I know the only debts that can't be discharged are child support, student loans, taxes and judgements due to drunken driving resulting in some type of injuries or death.
