Just need some advice. My husband and I file Chapter 13 in Feb 05. Since then we have been through 3 layoffs - with the most current being from January 08 to August 08. Anyway, we have received 3 - 3 month "extentions", each upping our payment after the three months. With the most current layoff, we met with the attorney immediately, I mean the day it happened. We applied for our third 3 month "extension" at that time. It was granted and our attorney told us to try to remain current on our mortgage and come back when husband gets back to work.

Well, husband finally started a new job 2 weeks ago and we just received a motion to dismiss our case from the trustee, we are over 5,000 behind on our case now and we cannot extend any longer - we are at the max of 60 months. Husband had to take a pay cut to get back to work. We have paid all but the current house payment (thanks to relatives) and there is no way we will be able to afford our Ch 13 payments anymore. According to the paperwork - we have paid in almost exactly half of what our plan is requiring us to pay back. We've paid in 21,000 and have about that much left.

My concerns are first and foremost our home. Our mortgage is $136,000 and we are finding that it may be worth 156,000 to 165,000. We can afford our mortgage just fine - with a job, as it is paid out of plan. We definitely need to keep our home. We have two young children that are very tied into the school, etc.

We also have two vehicles in the plan and some unsecured debt.

I guess my questions are what are options to keep the house?

We are just OVER this!
