For context. Im in NYC and Im in middle of chapter 7 bankruptcy. In meeting with my lawyer, he gave me the impression that if i was late on my car payments i would not be able to keep my car. I have a 2016 toyota rav4. I owe about 1200 and kbb says its worth 14k. It doea have body damage so i know its not worth that much. When i met with him to sign papers, he said he knows a guy that can give me “1-2 thousand” for the car instead of completely losing it for nothing. Fast forward to my 341 meeting he said he filed my car exempt under the federal exemption with wild card. He said if judge asked what id do with the car he told me to say i was keeping it.
So my question is Cant i just pay off the remainder of the loan and resell this car for much more than 1-2k after im discharged in 2 months? I feel bad to go against my lawyer but cant help but feel like im being taken advantage of here but i also dont want to risk fckng up my discharge. thoughts???
