Should I worry now that it has been 66 days since 341 without a discharge?

    First of all... chill out and go drink a cold one.

    Second.... there were no adverse filings, the time is up, so go back to #1 and drink a cold one.

    The trustee is most likely just behind in updating pacer.

    No. Especially no worry since it's California.

    Plus, upwards of 97-8-9 % of BK are discharged.

    And, 60 days is just a general ballpark time period.

    A little hint about Pacer....if you just do the query and look at the date of last filing you will know if anything has changed since you last looked. If the date is the same as the last time you looked, No change - No charge

    Thanks for the infor ST. i just got my first bill for pacer and i know exactly what you are talking about. Did you find out why your discharge took soo long to come?

    I was in Southern California and waited more than 100 days for discharge after the 60 day wait. Long, stressful wait but it finally came. The big hurdle is the 60 day post 341 period. If nothing filed then you are most likely good to go, just hang in there and try not to spend to much money checking pacer. I spent over $135 in fees because I checked the dam thing 3 times a day for 3 months!

    I would wait a little longer than make a polite inquiry of the clerk. I called 10 days after my 60 days and it turned out the clerk had SNAFU'd in my case. But that was unusual, I just had to wait another 60 days but then was discharged no problem. Just call and it will put you at ease, but wait a few more days.

    We had the same problem but we were an asset case. After months I simply called the Courthouse bk number. Have your docket number handy and go through the phone leads to your case worker. He/she will tell you what is going on. In our case they did not have a copy of a marriage license. We were never told about needing one, but we use different sir names. So I emailed to my lawyer who posted it. Three hours later, discharge. 'Hub

    I wouldn't worry too much about it. What ever is going to happen will happen whether you know about it now or later. After the 60 day waiting game expires it could take a day, week or month for the discharge to be in place. Filing and the 341 are certainly the hardest part of the process. Now just sit back and let it take it's course.
