If the Mortgage Relief Debt Forgiveness Act is not renewed, then from next year will a non-filing spouse be liable for income taxes on the forgiven amount of a short sale on a residence? The filing spouse will still be protected by the bankruptcy, but will the non-filing spouse have no protection?
