Our main business is already in the process of bankruptcy and has been shut down. We had a car that was in the company name and we voluntarily turned it in (felt it wasn't right to keep a high end car while business going under) We thought we were doing the right thing. Turns out my husband signed a...

Possible new SLAPP in Texas.
"SLAPP" = Strategic Lawsuits Against Public Participation. I filed a rather public consumer complaint against a regional tire dealer a couple of weeks ago. Totally factual. They finally refunded my money after several weeks of playing hide and seek with it, but the CEO of the company privately...

Civil Action Suit
Today I got a letter from a creditor basically saying to pay $750 by April 21st or they will file a civil action law suit. I am terrified. I am not even sure what exactly I am scared of, I think it is the threat that is scaring me. I finished my work book and am starting my BK hopefully within the next...

Answering a suit to stall in California
I've seen two conflicting pieces of advice about creditor lawsuits:
1. Always answer to slow them down.
2. Don't bother answering if it's an original creditor (OC) because they'll just get a quick motion for summary judgment.
I'm in California, and want, very much, to...Last edited by keptdigging; 04-08-2010, 08:05 PM.

Prejudgment attachments
Now that I know a suit from American Express is on the way, I have stumbled on this concept called "prejudgment attachment" which allows a creditor to seize or put a lien on assets in an ex parte motion pending outcome of the trial. In other words, seize first, notice later.
