    341 meeting

    Hi,

    Can you tell me if the trustee at the 341 meeting tells you then and there that he votes for dismissal or do you have to wait to find out his decision?

    I don't know for sure, but I would think that if there was a dismissal, it would be told after the 341 so that he/she can gather all the facts and then make a decision.

      The 341 meeting is the creditors hearing where under oath you are questioned by the trustee and (rarely) a creditor about your financial affairs. You don't find out at the 341 meeting if the trustee plans to dismiss your case or not. (Sophie, do you mean 'discharge' (say that your debts are wiped out and you get a fresh start) rather than 'dismiss' (your case is thrown out and you still have your debts)?

      Your creditors have 60 days after your 341 meeting to file any challenges ('objections') to your case. Once the 60 days are over, if no objections come forth (or the trustee does not agree with the objection), then the trustee or judge will decide whether he/she will discharge your case. Sometimes discharge happens quickly, sometimes not. Typically if your case is going to be dismissed (your case is thrown out and you are left owing all your debt), you usually will know there's a problem with your case shortly after your 341 meeting.

        Oops. Yes, I did mean discharged not dismissed. I was hoping that at the meeting I'd know if he was going to discharge me or not but I guess I have to wait the 60 days.
