    Reaffirment court date

    I just checked pacer and there was an update on our file Friday. There is a court date of 11/16/06 for reaffirment on our 2nd mortgage (this is the only reaffirment we have signed and did this at our 341 meeting). The reason for the meeting is 1. Certification of attorney 2. No payment amount listed on reaffirment to determine hardship. I had not received the copy we signed from our attorney yet so I printed a copy of it from pacer. If the certification is the signature, it was signed by our attorney, so I have no idea what thats about. There is not an amount on our reaffirment, just says vairable (our 2nd mortgage is just that) so that one I understand needs to be fixed. But one shocking thing I noticed was the reaffimed amount is 1,000 incorrect! It looks as if they just added their totals up incorrectly We did not get the chance to see or read the entire reaffirment before we had to sign it right before being called up at our 341 and I never noticed that, you can bet we don't do that again! I will call our attorney first thing Monday morning, but my question is: Can our attorney straighten this mess out or do we have to show up at this meeting? I was so hoping that we wouldn't have to take any more days off of work, especially for reaffirments.

    10/25/06: 341 meeting Done!
    12/25/06: Last day for objections.... Dear Santa, can we have a bk discharge for Christmas please?
    1/12/07: Discharged & closed!!

    A web search shows that it's very likely that you do have to appear in person at your reaffirmation agreement meeting so the bk court can ensure that you clearly understand what the reaffirmation agreement entails and that you agree to the terms. Of course, please ask your attorney about this - the practices in your district bk court might be different. HTH!

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Thanks Irprn. I did a little web search also and came to the same outcome as you. It does say that you have to show up at the court hearing. However, I noticed that most hearings are for ppl filing without attorneys. I wonder why a court date is scheduled for us when we have a attorney that could take care of the corrections for the reaffirment, etc. I'm also wondering if maybe this date will be cancelled if the reaffirment is corrected before the court date. Just thinking out loud.
