    overtime

    Hello all,
    I had a question about overtime,
    time to time I have overtime like 8-16 hours over a week
    it is not every week,but do I have to report it to the trustee
    and if so will it raise my payment plan
    thanks

    It's just me but I wouldn't. especially if it isn't every week and it varies. Unless you had a regular increase in pay and it was significant enough it's not worth it, cause what if you loose it, then good luck having it taken out of your payments.

      Depends on the instructions given to you by the trustee when you filed. Some trustees expect to be told about ANY extra income, some want to know only if the amount is greater than a specified amount, and some don't pay much attention to what you earn after you file.

      This is a good question to ask your lawyer. You could also look at the paperwork that came from the trustee's office when you filed to see if it includes any instructions about what to do about extra money earned beyond the amount you filed with.

      And remember that if your trustee has requested your income tax forms every year you're in Ch 13, that's one way he/she can discover you've been getting extra income over your income on filing day. Might matter, might not. Better to make a decision with knowledge than just guessing.

        Question, was that "variation" already in your income when you completed the means test or is this OT new? If it was already in the 6 month average (I'm assuming your new law), then I wouldn't bother. Best to ask your attorney for sure.

        I have a very similiar situation as you. My only problem as soon as I filed, they cut all the OT out. So, my income is less than the 6 month average they figured on...not much but some..cause I didn't make that much in OT to start with.
