    Order vacating Notice of Initial Chapter 13 Confirmation Hearing

    I just got back in town from having my 341 meeting. I had moved for work and filed in FL. Everything went well with the 341 meeting, but I got home to find a letter with "Order vacating Notice of Initial Chapter 13 Confirmation Hearing" on it.
    I had sent the first payment to the Trustee, but it arrived 2 days late. I'm thinking this is why I received the order. I started a new job and was broke until pay day on the 15th (same day the payment is due). So I am going to overnight the trustee the payment tomorrow. I have signed up for the automatic withdrawal to come out of my account on the 17th each month. This should start making the payments received on time.
    I think though I am already hosed. I have been doing this Pro Se, because I got rid of my attorney, when they did a lousy job on the Chapter 7 I initially filed. So it was converted to a 13.
    Am I right with my assumption?
    What can I do to fix things if any?

    Welcome to BK Forum, Mal. Sounds like your Ch 13 could be in serious trouble. Since you aren't living in your filing state, that adds a whole extra layer of complexity - that alone makes it a very bad idea for you to try to go this alone without an experienced Ch 13 attorney to help you.

    If your Ch 13 ends up dismissed (which sounds like your trustee is trying to do), the automatic stay will be over and your creditors are going to come roaring back with a vengeance. Don't delay - start looking for an experienced Ch 13 attorney in your filing state immediately to see if there's a chance of getting you out of this mess. Arrange for free consultations over the telephone if necessary, but this situation needs to be addressed as quickly as possible. Go to http://www.martindale.com/Bankruptcy...countries.html and click on your filing state to find other bankruptcy-specialty lawyers in your old city. Start calling today - don't delay!

    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

        Spoke to Trustees office

        I spoke to the Trustees office today and gave them an update on my situation. The woman said it looked to be just a formaility and a duplicate meeting had been scheduled for confirmation. According to her I am okay. I will definately keep track of it. My automatic deduction will take place next month and this should eliminate the whole issue.
