    Mortgage posting 120 days late but isn't

    Just found out last night that I am in the rolling 120 late mode from my mortgage company. Payments have been made for the past year, but they continue to say I'm late.

    I would really like to pursue this, any good tips on pointing me in the right direction.

    Monty, you posted this on a thread that is more than four months old which is a violation of our forum rules. You are much more likely to get quality responses by posting a question like this as a new thread, so I did that for you this time.     As far as what you can do about your mortgage reporting late when you aren't late - when our mortgage company filed an objection to our Ch 13 plan saying we were in arrears one month when we filed, we could prove with their own receipts that we weren't. Our lawyer called our mortgage company's lawyer and voila!, their objection was withdrawn .

    However, I don't trust our mortgage company not to try something else to take advantage of us while we aren't able to see our payment account. To ensure there's no question our payments continue to be made on time, I make our monthly payment at least 10 days before the 1st when our mortgage payment is due, and I use online bill paying through our bank to ensure I have an objective third party who can prove payment if that ever proves necessary. My goal is to do everything possible to avoid ever getting into the 15-day grace period as well so the company can't ever say we are late in future and charge us late fees. Sad that it's come to this kind of plotting and planning, but I'll do whatever I have to do to keep us from having anything extra to pad their pockets when we're done with our Ch 13 in 4.5 years.

      To get any sort of insight, we would need more back ground.

      First, have their been late payments; if so, how many, and when?

      Second, have you filed BK, if so when, are you discharged, did you reaffirm, etc?

      As a general matter, late payments are typically reported for 24 months.
