Can anyone give me any guidance? I am in a mess!
My husband and I filed bankruptcy one year ago. We never lived beyond our personal means, I lost a business and my husband's company closed in the same week over 3 years ago. We have not bought anything or repaired anything for years. We tried to be thrifty thinking we could hold off a bankruptcy and it didn't work.
Unfortunately we got a crappy lawyer and were in such a state of depression, we didn't realize what hit us. We thought filing would give us a fresh start and all it has done is create a nightmare. Our lawyer did not give us any guidance on what to budget. He just told us not to ask for very much or the trustee would question it and fight us on it. And we did what he said.
Now in order to survive financially we cut back on eating, I add water to our soap bottles, I will use a portion of a dryer sheet to dry clothes, both of our cars are over 10 years old, our shoes have holes in them, etc.
To make matters worse, I am a real estate agent and our market has gone down and because of my nasty car, etc, my ability to make money in real estate has dropped considerably. I had more expenses this year in real estate and I am behind in real estate fees just to be in this business.
I want to walk away from real estate as I am getting further behind. Will the trustee allow that? Am I required to earn the same amount, can we go back to court with a new lawyer, get a new plan, do I have options?
The anxiety is unbearable and everytime something comes up that is unexpected financially, I just break down. We are getting futher behind on a monthly basis and I don't know where to turn.
