    Mortgage Company's Objection Denied!

    The official notice arrived in the mail signed by our bk court judge today. Our mortgage company had filed an objection about two weeks after we filed Ch 13 stating we were in arrears one month on our mortgage payments when we filed but had not disclosed that in our forms. However, we were *not* late and could prove it with their own billing statements and our canceled checks.

    To make a long story short, our lawyer filed a "Debtors' objection to the Proof of Claim" in mid-December giving our mortgage company 30 days to respond to an Opportunity for Hearing. The mortgage company did not respond "in a timely fashion" and so our bankruptcy judge has ruled that "the Proof of Claimant is denied". One objection down! Sweet!!

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

    I wonder how many people, how many dollars every year, CC's and Lenders in general bully themselves into getting paid.

    All based on their supposed "faulty accounting procedures". However do they justify the bottom line??!! How do they explain all that excess??!!
