    Papers needed.

    Just going through the file I am putting together for all our financial stuff in preparation for filing BK (still haven't decided if we are going for a 7 or a 13, but we are going to file)
    Just discovered one of the pay stubs are missing.
    How strict are they on having to actually have all pay stubs for the past 6 months?
    There is no way I can get a new copy either, as my employer doesn't keep any.

    Also, how much stuff am I actually going to need?
    I mean, is 6 months worth of CC bills, etc enough, or should I hang on to a years worth?

    Are you certain that your employer doesn't keep any kind of retrieveable record for the payroll checks they provide? If that's true and your company is ever audited by the IRS, the auditor is going to have a field day since apparently there's no way they will be able to prove their employee payroll costs and taxes paid (which means it's hard to believe that your company has kept nothing at all on record for you).

    If your six months of checks vary by amount each time, then being able to prove what the missing one was for becomes more important. If you deposited the check, could your bank/credit union provide a copy of the deposit slip or that month's deposits into your account showing that single paycheck deposit and the amount? Those could be acceptable substitutes.

    Ultimately what matters the most is what your lawyer says about the missing check and how important it is to replace it. This is a good question to ask during your free consultation interviews with 2-3 bankruptcy lawyers in your area.

      We had a couple missing from the previous 6 months. Older ones that weren't filed immediately when Hubby got paid, I guess. Hubby contacted payroll and asked about getting copies. The gal told him, if it was just 1 or 2, she could print them out right there in the office. Otherwise, she would have to call the company that handles their payroll to get more. Since it was just 2, she printed them out right there in the office.

      Check with payroll and see if they will give you copies. And, you don't have to tell you're filing BK. It is tax time. Many people organize financial records this time of year. Just say you were doing your annual "getting all your records together" and noticed you were missing a couple of paystubs. Would it be possible to get copies??!! It probably won't be any big deal at all.

        I have asked payroll.
        They said there is no way to get a copy of a pay stub as they don't keep them. The best they said they could do is give me a print out of my quarterly earnings. Just a total with no breakdown by week.

        I don't know how they track anything for accounting. I just know what I was told.

        If it helps though.
        The YTD amounts are right there on the pay stub before that check, and the pay stub after that check. So anyone can see what the missing paycheck was actually for.
        My pay is hourly and we don't have any OT. So my checks are basically all the same. Except around the holidays where we had some extra time off due to not a lot of work.
