    Attorney asking for more info...

    Last day for objections is March 12th. We've completed the pre-discharge counseling etc. Nothing filed on our case since Feb. 6th.

    My attorney told me today that I'll need to provide her with pay stubs and bank statements from Jan 11th (date of 341) to present. Is this normal??? Is this an indication of a problem or just SOP to make sure our financial status hasn't changed since the 341?

    Our attny didn't want any thing from after the day we filed.

    I took pay stubs from between filing and the 341 with us to our 341 thinking our attny would need them but he didn't want them.

    Anything that happens after you file BK is not part of the BK estate. That was set the day you filed.

    Maybe your attny is just being thorough??!!

      Our trustee specifically asked us in a letter to bring our two pay stubs FOLLOWING our filing date to our Ch 13 341 meeting. Our lawyer said that this was likely due to case law coming out at that time that seemed to support that it wasn't just the previous six months of income before filing that mattered, but that what you earned *after* filing could be considered too. This despite the fact that the new bk law seemed very clear that only the previous six months of income was to be used on the Means Test.

      We brought our two after-filing pay stubs along with us to our 341, but our trustee never asked us for them. Wouldn't have mattered if he did - the amounts on them were identical to what we had on our pay stubs before filing anyway.

      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        I think the difference here is that SF filed Chapter 7, while lrprn filed Chapter 13.

          Spoke with the attorney yesterday evening. She said our District requests this info to make certain a person doesn't file just before receiving a large influx of money or a significant raise. She said there was no indication of any issues with our case and she fully expects next Monday to pass with out incidence and our case to close soon thereafter.

          If something comes up I'll post it...
