    Mortgage company objection

    Just got my Pacer account.....and I should have waited until Monday.


    Here is the question I show that my mortgage company objects and then they quote U.S.C. 1325. They request all legal fees associated with the objections are paid by me.

    I am wondering what they can object to. They will get all of their arrears through the plan and the mortgage will be paid outside the plan....... I was behind, but they never filed for a foreclosure so what the heck would have gotten then hot and bothered?

    My confirmation is set for 5/17 does this objection sound typical, just trying to squeze me for a couple extra bucks?

    Here's a link to Title 11, USC 1325 - http://www4.law.cornell.edu/uscode/h...5----000-.html . It's the confirmation of plan statute. This is just a guess and I'm not a lawyer.....perhaps your mortgage company doubts that you can pay the mortgage in a timely manner given the amount of income you have???

    Call your lawyer first thing Monday morning. He/she will have been notified about the objection (you will be too by mail very soon) and should be able to tell you more about what the objection is about.

      does this happen often, where the mortgage company says they want to object and do they usually win?

        Mine objected due to some extra fees they wanted included. My lawyer handeled it so I don't know why they agreed to drop it. My lawyer actually never talked to me about it, I saw it on Pacer.

        If you have a good attorney you should be able to work through any objections.
