    Almost done

I am within a few months of completing my chapter 13 plan. (Filed 2003). I have a question, have asked my attorney but no return calls for my questions. So I will ask those of you who have experienced this.

I am sooooooo close to being discharged, lived through the struggles of surviving a 13. My unsecured debt owed to other creditors is less than $100. The other debt owed are my 2 student loans, here is my question, I would like to consolidate those student loans now and payoff the remaining creditors which is less than $100. I am getting anxious to end this 13 and don't really want to wait another 6 months to take back control. Is this possible? Like I said, I have left many, many, many messages to my attorney with no response. (Been leaving messages since last Fall). Any responses would be greatly appreciated. Thanks.

A BIG congrats on managing what only 30% of Ch 13 filers can do - successfully finish their plan! Way to go, jojo!

I understand all too well how anxious you are to start paying on your student loans. However, since your 13 case is still active, if you start doing this now, your trustee will have to give permission to consolidate the student loans. Also it may make him/her wonder where the extra money to do this is coming from since your case is supposed to be getting all your disposable income. Don't want to start rocking the boat now so close to the finish line.

Call your lawyer's office and book the earliest available half-hour appointment for a face to face meeting with him/her. It's a shame to have to do this, but you really do need expert advice before accidentally doing something that could jeopardize your case in any way this close to being done.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
