    Letter of explaination along with required docs to trustee

    Has anyone ever send a letter of explaination along with the required docs ie 6 months bank statement, 2 year tax returns etc. to the trustee?

    I really want to explain my health situation to him. When he sees me I am not some fragile looking person, I am young and healthy looking outside the fact that I have to wear a cast and foot brace and use a wheelchair for long distance (hopefully, only temporary) prior to this year I had been fighting to save my vision in one eye through three eye surgeries and twice a week eye appts. multiple eyes glasses changes and I have to wear a aphakic contact lens in my left eye which cost $120 a pop and has to be change every three months. but looking at me you will never know. Right now I just look like somene who broke their leg or ankle.

    I just wanted to give a brief summary of my condition and the fact we are going to use our Indian reservation money to pay down our taxes>>

    Is this a dumb idea or wise??? Has anyone ever done such a thing.

    Maybe instead of a personal letter of explanation,.......... Have your Doctors write letters detailing your medical conditions and various treatments you've received.

    I'd think letters from physicians would be much more substantive and compelling than a "personal" letter of explanation.

      I'm not an attorney, but I would suggest you run this by your attorney - or some attorney- before writing any letter. I think SinkingFast has a better idea, of having the doctors just outlining your medical condition and needs. The less you say to anyone, the better, as you may unwittingly "put your foot in your mouth". That's what I would recommend. If you do not have an attorney then, I would go the route of having the medical doctors write up something.

      I could be wrong, but in the end I think they are only going to look at your expenses and income. If you have a lot of medical related expenses, then you will want to back it up with receipts and maybe letters from doctors, but I think that should be sufficient.

        When we filed Ch 13, our medical costs were well above average for our district. My husband is an insulin-dependent diabetic and I have several chronic medical conditions including hyperthyroidism controlled with meds and a corneal transplant that requires regular follow-up visits and special drops. We had receipts for everything going back six months in case our trustee asked us to prove what we had on our forms.

        During our 341 our trustee did indeed ask why our medical costs were so high. Husband and I briefly explained our situations. He nodded and went on. No more was said about our medical costs and it has never been a problem in our case.

        06/28/06 - 341 Meeting
        07/18/06 - Confirmation Hearing - not confirmed, 3 objections

        01/24/07 - Judge dismisses mortgage company objection
        09/27/07 - Confirmed at last!
        06/10/11 - Trustee confirms all payments made
        08/10/11 - DISCHARGED !

        10/02/11 - CASE CLOSED
        Countdown: 60 months paid, 0 months to go

          I have type 1 diabetes as well, I was told that to just leave it alone. On the attached addedum to schedules we broke down the cost of medical expense and where it went. We were told that would be enough. My friend told me to not to give any more additional info then what is needed. I swear she had serious stuff in her closet, I mean extra income, lied on taxes, you name it and she had no problems and the BK discharged and closed back in Nov. 2006. Thankfully, I have nothing to hide, to be honest I wish I wasnt in this position, I just wish some money would just drop out of the sky LOL>

            When I wrote a statement of income I did include a few lines explaining the medical conditions concerning my family .
            Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.
