    Update on 8500 IRS claimed

    Well our orginal plan was to pay 720/mo & now that IRS made claim & trustee wanted the cigarette expense removed our attorney ameded plan & now the payment is is 820/mo. We are only paying the IRS 3577 of the 8500.

    Question is attorney faxed amended plan for us to sign & its states that all of our disposable income shall be paid to thetrustee in the amount of $0 for the 1-2 months & $820 for 3-60 months. I filed on June 21, 341 on 7/16, 1st payment was due on 7/25 but our attorney advised not to pay & to catch up our insurance. So does that mean I wont acutally have to pay first trustee payment until September?

    I would check with your attorney to make absolutely certain. The revised 2005 bankrutpcy law states that you are to pay your first Ch 13 payment within 30 days of filing. You don't want to get your case dismissed right at the start over this kind of misunderstanding.

    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !
