hi ....I doubt that within 90 days you would be in small claims court with this account... if
you are only 1 payment late probably won't go to collections either.....my case, collections
on one card happened after 5 or 6 months of late or no payments. As soon as you file and
get your case # tell them....your phone will stop ringing.....good luck

This creditor is calling you frequently to create the frustation and anxiety you feel, glc. They are the buzzing fly that hopes to get so annoying that you will pay up just to get rid of them. DON'T DO IT! Most of us have lived through the horrible pre-filing calls deluge....it's surviveable if you use strategies to keep your sanity. Search through the forum stickies and forum posts for effective approaches members have used to survive the intense pre-filing phone calls period.

It's best to not talk to your creditors and collectors because it's easy to give away information or make promises that can really trip you up later. You are not required to talk to these cockroaches.

About the small claims court threat....even if they follow through (and I suspect it's just a scare tactic), let them try. Even if they get a judgment against you, you can include it in your bankruptcy, then file a motion to wipe it out after your case is closed.

Hang in there, and remember as bad as the phone ringing is now, after you file shortly you will have blessed peace and quiet once again.

i had a card with them, i haven't paid on it or any of my credit cards in about 5 yrs now. they send letters every so often, and a few of them have my current phone #, but otherwise i don't hear much... and i haven't been particularly hassled by this card. i have another one from the same bank/company... Victoria's Secret. same deal.

Most of the CC's have a process they go thru.

Regular Customer Service will call you to get you to come current. That will last about 2-3 months. Then your acct will be moved to Internal Collections. Lane Bryant's Collections people will try to get you to bring your acct current. That lasts usually 2-3 months. Then your acct will be turned over to an external Collections Agency.

You're looking 4-6 months from the first missed payment before any serious Collections attempts even begin. And at that, the Collections Agency will try to wring money out of you before proceeding with legal action. The CA's get a cut of what they collect. Legal fees cut into the CA's profits.

Somewhere in the 6-9 month range, the CA may move on you legally. All you have to do is file a letter of Response to stall that action. Ask them to Validate the Acct, the $$$ amount, whatever. That'll buy you an additional month or 2. You can probably go a year from the first missed payment without too much trouble.

Turn off the ringer if you need to. Get an answering machine to screen calls if you don't have Caller ID. Answer the phone only when it's someone you want to talk to. Let the Creditors talk to thin air.
