I went to Bankruptcy court yesterday and was confirmed. The trustee only had one objection which was me not adding in my child support and the judge said that it was just a mathmatical error and that there was no reason that we could not confirm.

He also told the trustee and ordered that I make up the difference in the original payments and the payments now by having it deducted from my tax return that they already get. He said that there is no reason for me to have to worry about making up the difference now and not to think about it again until tax time.

I admit that I was scared the Judge and the trustee both had many things to complain about the people before us and neither of them were happy with the way things have been going in their case. Ours was easy and painless and confirmed although I asked the Judge for an extension to change my paperwork he said that it was not required. We waited around afterwards for the trustee because she said she would talk to us about what the judge was saying and she said well you are confirmed and he says that you can make up those payments at tax time so you are good.

What a relief it was a lot of work and a lot of worry as well as many things that were trial and error and although I don't know that I would do it again pro se it was really not that painfull of an experience......

You must be so relieved and happy, BA!! You've achieved something very few pro se Ch 13 filers manage - you survived filing and it looks like you are going to get confirmed - way to go! Keep us posted about when the confirmation becomes official - congrats!

Well it is official received letter in the mail today saying that we are confirmed without anything further.

I never thought that I would feel this great handing over 542.00 a month for 3 years plus over 7000.00 a year in taxes but the worst is over now and I am relieved that this part of it is complete. All of the hours I spent preparing this and stressing over this are over and I am already down to 33 payments.

Thanks again for all of your help.

how long does it take to confirm? Do they have a timeline?

how long does it take to confirm? Do they have a timeline? If the court agrees with your plan, then confirmation comes within a few weeks of your confirmation hearing. If your case has objections, then it can take a lot longer. We're still unconfirmed a year after our confirmation hearing while we deal with our trustee's two objections to our case. (Already took care of our mortgage company's objection - judge threw it out :) )

We're the perfect case in our district to test allowing payments to 401K loans while making contributions to our retirements at the same time, and the ever-popular Means Test vs. Schedule I&J disposable income mismatch. Our lawyer is filing an amended plan and we hope to be confirmed by the court very soon!
