    Always wanted to ask this

    Even though I'm in a BK13 currently.

    If you've filed and have recieved your proof of claims, which creditors filed for them? I'm going to start a list because I know I wanted to know when I was filing.

    Mine were:

    American Express Business
    Capitol One
    Chase
    Pier One
    Citibank
    Washington Mutual
    Hooters/Merrick Bank
    Patelco Credit Union
    HSBC

    didn't file:
    Banana Republic
    Home Depot
    Dell
    Best Buy

    Citibank (3 cards)....(I owed them about 35k...go figure why they didn't file a claim)

      Can you explain what you mean? So if they don't claim, you don't have to include them?

        You include everyone when you file. Then they have a chance to file their claim. If they don't file a claim, you don't have to pay them back anything.

              That's right. No claim, they get no money at all. Total amount you owe a creditor that doesn't file a claim is wiped out in full if you complete your Ch 13 successfully.

                WoW it just seems to be luck of the draw as to who files claims. We are filing in Feb. I will let you know who files claims.

                  I have some who posted claims that I believe where junk debt buyers who saw my ch 13 filing and just jumped in. My attorney would not fight them. One of them is called Round Up Funding. I have written my states attorney about it since my lawyer quit on me due to my pushing this issue.

                    Are you certain that your legitimate creditors didn't move your accounts to companies who will manage your Ch 13 payments for them? This is a very common practice after you file Ch 13. Half of our creditors did this within several months of our filing. It's a legitimate practice.

                    Also it's common for the original creditor to sell your debt to a collector close to filing.

                    What proof do you have that some of the companies that filed claims are junk debt buyers that have no connection to you?

                      alright. I included a hospital bill in ch 13 ($2500). After I filed they called twice and I explained to them that I filed and gave them attorney info. A few weeks later a collection agency called I gave them my attorney info and told them I had already given the hospital the info. They called 2 more times before they spoke to my attorney. Who do I owe the money to? If I filed for the hospital will it carry over to the collection agency? Or do I have to amend to show a new creditor?

                        You might want to send them a claims form. You can download it from the internet and then let them file a claim. E cast filed for one of my claims but it was after the bar date and HSBC just transferred the collections of it over to E cast. But no claim filed, they get no money. I am so close to being done now I can taste it and I can't wait. I didn't have many big time cc debt to any of the big companies. Mine were HSBC and Cap 1 and Providian. LOLOL My issue was deliquent apartment rents and repo'd car deficiencies and medical stuff, bad checks, and private student loans. Not very many filed claims in my case. 1 apartment complex did and 1 cu for the amount I was into them in the hole. No medical ones filed claims at all. HSBC did and so did Cap 1 and so did Auto Owners. Wells Fargo filed on my private student loan for my daughter. Not one repo'd car lender filed for any deficiency balances. I will be discharged here soon. Yeah!

                          rrockinggramma, how long was your plan originally and how long will it actually end up being? Ours was supposed to be 40 months/$650 a month. A co-signer paid a loan of $2500 so that knocks off 4 months (by the time you also figure in trustee 4.3%). So I am hoping that the hospital claim doesn't get filed either. That would take another 4 months off. We have made 3 payments so far into the plan. Our other creditors (besides mortgage companies) are cell phones, payday advances, book movie and music clubs. Has anyone had experiences with any of these?

                            I filed on all that stuff, nextel, sprint, doctors. Junk really, not even big credit card amounts like others here. I could never qualify for all that stuff cause they always told me I had too much debt already. And what I did have was secured by my home (stupid move, I hate equity loans) and vehicles. None of them filed claims. I had about 82,000 in unsecured and less than 16,000 of it was filed in claims. I am paying back 65 percent and will be done here soon. My plan was for 36 months, which is up August 3,08. But the trustee disallowed a claim for me to Consumers Energy (filed 2 claims, so he disallowed 1, the higher one !!!) and that means that will all be paid up in April. I am hoping to be discharged by July but probably will have to wait until August 3, 08. LOLOL I am already talking to a mortgage banker about FHA and he told me credit scores around 600 and discharge date from trustee. I am almost there with the credit scores and so just waiting on discharge. I can't wait to be a homeowner again! Been a long time since I have had "roots"
