    341 Done!!!!

    I had my 341 meeting today. What a day! I got to the building an hour early because I live 3 hours away and I left early in case of traffic or Murphy's Law. When I got there, I found out they were running 2 hours late so I knew I was in there for a while. They called everybody in one at a time so I didn't get to see the other meetings. Some people were in there for only 5-10 minutes but most were taking a looong time. I was getting progressively more nervous as time went on. I was the ONLY pro se filer there and I figured I was going to get raked over the coals since he was taking so long with the other cases. I finally get called and when I go in, the lawyer for the previous people was still packing up his stuff. THe trustee says, "This lady deserves an award." I thought he was talking about the long wait or something but then he goes on to say that I had the best pro se papers he's seen and he thanks me for doing such a nice job and turning everything in on time! He then starts the official record and commends me 3 more times on the record for my papers. He even made a comment how the reason he was behind was because the lawyers can't get their sh** together. So I had better papers than the attorneys. He declared me a no asset case and told me I can expect to receive my discharge papers about a week after the last day for objections. So it looks like I'm golden! My only other hurdle is that I'm reaffirming my vehicle so I think I have to go in front of the judge for that. The loan holder is filing the motion and all that for me but I think I have to show up since I don't have an attorney. I haven't researched that part of the process much yet because I've been so worried about this part. I'm going to take my 2nd class this weekend - I wanted to wait until after the meeting in case I had screwed something up.
    I'm walking on air right now!! Thank you everybody for all the support and advice I got on this forum. I feel like I've won something...

    Glad to hear your 341 went well.

    The reaffirmation hearing is not a big deal. The judge will basically explain to you the implications of a reaffirmation, ask you if you understand, and then probably ask you some question to see if the payment would be an "undue hardship" on you.

    One thing you might try to do is use the reaffirmation as a way to negotiate a better deal with the car company. Reaffirmations are not required to have the "exact" same terms as the original note. Sometimes, you can negotiate a reduction in the principle balance, shorten the term, even perhaps lower the interest rate.

      You did great! The judge thing will go fine - the law requires it if you don't have an attorney. The judge will ask you if you fully understand what you are signing and whether you can afford the payments.

      I would think it would go smoothly too.

        Thanks for the info on the reaffirmation. I feel like if I made it through the 341 I can make it through the rest. I was able to get them to lower my interest by 6.5% - which gives you and idea of how high it was before
        It'll be another day off work and another 6 hours of driving but it's sooooo worth it in the end. I'm already feeling that burden starting to lift.

                way to go! had mine yesterday, was scared to death but ended up being a huge non event!

                      Yeah! This is a good week for 341's here. Im still waiting on an update for pacer...who knows how long that will take.
                      I was very lucky to have a great rate on the car already at 3.9% I wont see those rates for a long time again!! Glad you got a good rate now. Anyhow, welcome to the 60 day club!
