tiredofdebt1 09-28-2007, 10:30 AM Hey Guys....I finally retained my attorney. I am going to pay the remainder $$$ on 10/15. How long does it take from the 15th to file? Also.....i know now I can refer my attorney to all my collectors....but do i keep my mouth shut to my auto finance co. until i actually file? im still due for sept...didnt pay this month.....although im surrendering my vehicle..im afraid they will put a judgement against me immediately.....and try to repo the car before i can file in 2 weeks.....what do you all think?

We retained our attorney 2 wks ago. At that time, I owed my August 3rd payment and my Sept 3 payment. I kept the car in the garage for the last two weeks, and my attorney filed yesterday for us. The key, according to my attorney, was the timing. If I had been behind just on one car payment when we retained him, he said we would be fine. But since I was behind two payments when we retained him, it was more urgent for us to get the filing done before they repoed it. So for the last two weeks we kept the car in the garage and I didn't take the auto loan phone calls. Attorney filed yesterday, so I can officially move the car out.
Talk to your attorney, let him know how far you are behind and ask for his opinion on the situation.

If I understand you correctly, you are asking how long after you pay your attorney, can he file? He could do it that day if he was prepared and has all your paperwork and documents (taxes, pay stubs, bank statements or whatever it is he requires). You should ask him if he can file asap after you pay him, if that's what you want. If you want to include September's pay but not October's then you need to file before the end of October.

Depends on how busy your attorney and his/her staff are and how complete all your documentation is. Ask your lawyer exactly what he/she needs to complete your forms and start pulling that together. Also ask how long it will take to file your case once the fee is paid in full and they have all your needd documentation.

Most car lenders won't even start thinking about repossession until you've had two missed payments in a row. You should be ok if you file before your third missed payment.
thewife 09-28-2007, 02:07 PM It took me a little over a month from the day that I paid off my remining balace for me to file. They forgot that I had paid and so it took longer than usual, plus they were swamped.
tiredofdebt1 09-28-2007, 08:18 PM good feedback...thanks guys.....i was trying to figure out if i should go ahead and pay this month.....but since the plan is to file in oct.....im not paying...the finance co. has called my mom and left these rude harrassing v/m. i told her to save them just in case....and i didnt think they could tell my mom all of my business

However, the FDCPA law states all they can ask a relative, neighbor, or friend is how to find you.
Obviously though, many bottom-feeder collectors deliberately violate this part of the law. They are using your shame about others knowing you are struggling financially to get you to pay up. That's all they care about - getting your money any way they can....no holds barred.

In regards to the repo... I was 4 months behind before I heard from the bank about coming to pick it up. At that point, I arranged a time for them to come get it. Allowed me to get valuables, etc out of it.

Our attorney told us the auto loan company could repo within days, weeks, months. He did tell us on Thursday when he filed to get everything out of the car that day just to be safe. We have done that. Also, the car needs gas (fuel light is on), I thought I'd leave that for the repo guy!!! Only fun I have left, HAHA.
We voluntarily surrendered our car, and when we met the repo guy, the car had about 10 miles left on the range :)
