Okay- I have a few questions.. I filed chapter 13, without my husband on March 30. My plan was confirmed and I made payments on the plan until September, when I converted to chapter 7. My 341 meeting is on Oct 23. I am moving out of state on Oct 26th.
My husband DID NOT file, I am not working, and have not worked since August 2006.
These are my questions:
My husband is set to get a raise, going into effect on Oct 15th. He will get approx 150 more per paycheck, or $300 a month more , after taxes. (We were below the median, so my attorney did not even complete the disposable income part of my chapter 13 petition.) Do I need to report this to my attorney and the trustee?
Also, as I said we will be moving out of state on the 26th, and my husband will have to take out a pay advance to finance the move. So on the 23rd it is possible that we will have almost $2000 in our checking account. Do I need to report this to my attorney and the trustee?
One more.. I got a letter from the trustee stating that I have to provide bank statements, cancelled checks, and income tax returns within 5 days of any request.
Since I have not worked, would it be more beneficial for my husband to file taxes as married filing seperately, so that they could not take his tax return, and have me just not file a return at all?? I do not plan on working this year.
Thanks!
