    New Zealand / Australia Experts

    Hi everyone,

Well Im $60 000 in debt in New Zealand, all unsecured on Credit Cards and Bank Loans. I was made redundant 8 months ago earning $100 000 no Im earning $40 000, and was fine paying off my bills but now its taking its toll by not being able to make the min payments. So my wife and I are looking at going bankrupt.

We now live in Australia, all our debt is in New Zealand, I need to ask a couple of questions that I need help with, your advice /experience is appreciated.

    1. If we file for Bankruptcy in New Zealand, will it affect our Australian Credit Cards eg: Amex Card can they cancel them??

    2. If we file for Bankruptcy in New Zealand, how will that effect the motor car we own here, can they sell it even though it is in Australia and Not New Zealand.

    3. When we fill out the Bankruptcy forms, do I only list the NZ Debt, do they need to know what I own in Australia??

Your help/advice is appreciated. Thank you.

I think you will find that most everyone here is in the states...I'd try googling some more to find the right forum.

You need to find an attorney that deals in International Bankruptcy involving debts in one country and living in another......

Don't know where to tell you to look unless you check in New Zealand where the debts are originally....

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

As you've already been told, BK Forum is based in the United States, so we don't have any expertise for bankruptcy in Australia or New Zealand.

However, a quick Google search turned up the following excellent resource about bankruptcy in Australia - http://www.fedcourt.gov.au/litigants...tcy_intro.html

And here's one about bankruptcy in New Zealand - http://newzealand.govt.nz/record?recordid=625

Hope this gives you a place to start your research - good luck!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
