    13 datacenter

    I checked 13 datacenter tonight and on November 1st they had disbursement of my house payment and the other disbursement was refund to debtor/case closed. Then on November 2nd they received more money from my payroll dept. I assume I will get this back too, but I was thinking I should be seeing something on pacer like a "stop payroll deduction order" I guess its possible that its just the proximity of the dates.

    Any thoughts? It looks like its comin to close

    You might wanna call your attny, if you filed with one, and remind them that your wages are still being Garnished by the Trustee. See what they say.

    Whatever you over pay will be refunded to you eventually.

    When the Trustee finishes distributing proceeds from your Plan Payments, then he/she performs a Final Audit. All monies that came into and were paid of your Plan, and to who. Once that's done, your Case will be Discharged and Closed.

    Any excess funds in your Plan POT will be refunded to you after the Audit.

    Wanted to add,..........

    Someone a while back refi'd their house to pay off their Plan early. Their wage garnishment was not lifted for a couple more months. Sometimes the wheels of Justice move slow. Maybe the screaky wheel will get the grease if you call and pester a bit.

      If they have issued you a refund doe this mean they're done with your audit and discharge is close?

        thats what im not sure about...13 datacenter says case closed, but i thought discharge came first and have not seen this on pacer or 13 datacenter

          Let me know what you find out as I am in the same situation. My status is active but case closed noted Oct 8. Refund to the debtor dated Nov 1.

            Me too

            Mine went from "About to close" on Oct. 1st to "Completed" on November 1st. There's a balance of about $2500 sitting in there, I have no idea when or if I'll get that back. Nothing on PACER either. My lawyer is no longer responding to calls or emails, so I guess I'll just wait and see.

              That is about the amount I had "left over". But that appears like it is the trustee part of the plan. It was for me.

              I had $2,456 left at the end, and that just happened to be 10% of $24,560 total paid in. Which was the trustees 10%.

                I received my refund checks in the mail today. One was for the balance on hand and the other was for the payroll deductions that came after she ordered the order to terminate wage assignment. My attorney told me to cash them immediately because they wouldn't close my case out until all checks have cleared. Hope that helps. My case was listed as closed on Oct 8.

                  thanks for the info....I received my refund check yesterday and there is more that has been paid into the account since check was issued. The order to release wages was entered on PACER today.....

                    had a letter in my mailbox when i got home today from the trustee. Kind of nice actually, it was a notice of completion said that they will file a final report with the court and that the court will be preparing for the discharge. The letter went on to congratulate me for completing the plan as approved by the courts.

                    There was also a second note with some tips for rebuilding credit and some steps to take. I have to say my trustees office was nice throughout the entire process
